The U.S. Equal Employment Opportunity Commission recently launched its first two suits challenging corporate wellness programs under the Americans with Disabilities Act, but don't expect the commission to issue guidance anytime soon for employers seeking to use those programs to curb health care costs, EEOC Commissioner Victoria Lipnic said Thursday.
Lipnic also addressed the attendees at a client briefing hosted by Epstein Becker Green, discussing areas such as the recent wellness program and the overall volume of EEOC case filings.
After being asked about wellness programs by Epstein Becker's Frank Morris, who pointed out that the programs have won support from other federal agencies and can rein in runaway health care costs, Lipnic said that the issue was on the EEOC's agenda but that clarification in the near future wasn't in the cards.
