The development of condominium-hotels is increasing. We assist clients in all aspects of their projects and have particular experience in preparing the governing documents for many different types of condominium projects, including residential, mixed-use, "air rights", and condominium hotel projects. We have extensive experience in structuring governing documents that preserve flexibility in favor of, and reduce legal exposure to, the developer. In addition, we advise our clients on issues related to the nuances of "hotel and residences", including preserving control over maintenance after transfer of control of the residential condominium association, addressing cost allocation challenges, implementing transient occupancy and rental management programs, and addressing potential pitfalls of marketing real estate when coupled with rental management programs. We also counsel our clients in dealing with challenges presented by the hotel operator in exerting influence on the governance of the project.
