Epstein Becker Green achieved a significant arbitration victory for a waste management company accused by a former employee of wrongful termination, retaliation, and wage-hour violations. The arbitrator rejected the former employee’s claims and ruled in our favor. The arbitrator found our client’s witnesses credible (bolstered by consistent documents and the former employee’s own admissions), while finding that the former employee was “inconsistent and generally not credible” based on several areas that Epstein Becker Green attorneys were able to impeach him on and otherwise expose his true nature. Notably, the arbitrator found that the client had provided the former employee with all meal and rest periods and that the former employee’s termination was legitimately based on his failure to report an accident, not on any unlawful or retaliatory basis.
