Alan J. Arville and George B. Breen, Members of the Firm, will speak at the AHLA Physicians and Hospitals Law Institute, which runs from February 8 to 10, 2016.
On February 8 and 9, Mr. Arville will co-present "340B Hospitals: Anticipating and Responding to Evolving Compliance Standards and Audits in Wake of Proposed 340B Mega Guidance and Orphan Drug Ruling." Topics include: The impact of HRSA’s Proposed 340B Drug Pricing Program Omnibus Guidelines (the “Proposed Mega Guidance”) on hospital covered entities; compliance with state Medicaid billing policies and impact of the Proposed Mega Guidance and proposed CMS rules on Medicaid managed care duplicate discounts; best practices for self-assessments and external compliance reviews of internal operations and contract pharmacies; best practices for preparing for a HRSA or manufacturer audit and current trends in audit findings; impact of recent court decision vacating orphan drug interpretive rule; potential legislative changes and other industry and regulatory developments on the horizon.
On February 9 and 10, Mr. Breen, Chair of the firm's National Health Care and Life Sciences practice, will co-present "The Intersection of Quality, Payment, and Government Enforcement." The session will first discuss new enforcement risks for physicians and hospitals and the legal theories the government pursues in quality care and medical necessity investigations. Presenters will also discuss how reporting requirements impact payments to providers in connection with the false claims act, and how quality and medical necessity should factor into an organization's fraud and abuse program and compliance obligations.
