Retaliation and whistleblower claims are on the rise. For the past few years, retaliation claims have constituted the majority of claims filed with the EEOC, surpassing claims for age, disability, race, gender, and religious discrimination combined. Congress and the RI General Assembly have recently enacted sweeping anti-retaliation and whistleblower protections, which impacts most employers.
Agencies including the SEC and NLRB have been active in prohibiting “pre-taliation,”striking down common employment policies and agreements that they believe may negatively impact protected activities.
