Class action litigation in the wage and hour space continues to evolve, with novel theories of liability being tested in courts nationwide that present both challenges and opportunities for employers. This panel will explore emerging trends, including the latest case law on collective and class certification, strategies for defending against the leading types of wage and hour claims, and the growing focus on state law wage claims. Attendees will gain practical insights into mitigating the risk of costly wage and hour class actions while strengthening compliance and defense strategies.

10:10 - 11:10 a.m. - The Eras Tour (Union Organizing Edition): Changing Presidents and Attitudes Toward Unionization

Quiet Quitting, Coffee Badging, Rage Applying, Barista Uprising, GenU, and Lazy Girl Jobs. Delve into the dynamic world of union organizing among the newest generations joining the workforce, including how the aspirations and perspectives of these generations differ from their more experienced coworkers changing union organizing tactics. We will explore the driving factors of modern organizing efforts, evolving communication methods, and campaign tactics of millennial and Gen Z organizing. Participants can expect to learn about cultivating harmonious labor relations and maneuvering through the complexities of a workforce composed of multiple generations. We will discuss real-world cases that will address how to react effectively to modern unionization efforts and changing views of the workplace.

11:20 a.m. - 12:20 p.m. - Employment Law Audit/Handbook Strategies (That Work)

Whether through a remote-first philosophy or brick-and-mortar expansion, an increasing number of employers are finding themselves in new jurisdictions grappling with a patchwork of state and local leave laws. As every state and an increasing number of municipalities pass their own versions of leave laws, employers operating across the United States must make seemingly endless updates to handbooks, policies, payroll systems, and more. Additionally, recruitment and retention efforts are driving employers to be more creative and empathetic when granting time off to employees. We will provide a guide to navigating the diversity of state regulations, managing compliance, and coordinating leave policies for a geographically varied workforce. We will also consider trends in leave, such as flexible or unlimited paid time off policies, forms of bereavement or reproductive loss leave, and parental leave. This session will be an essential resource for multistate employers striving for legal compliance, operational efficiency, and positive employee relations.
