For years, hospitals and health plans have closely guarded information regarding negotiated prices. Indeed, such data and information has been deemed highly confidential by health industry participants, and viewed as competitively sensitive from an antitrust perspective. As such, the Administration's recent push for price transparency in the health sector has sparked considerable debate in public and private sectors. Will making hospital prices publicly available to consumers result in lower or higher costs? What impact, if any, will the anti-gag clause legislation voted out of the Health Education Labor and Pensions Committee in June 2019 have in the health care industry if signed into law? Are there economic and/or public policy reasons that support the price transparency initiative? What role does or should antitrust law play in these discussions surrounding price transparency?
