Adam Forman of Epstein Becker & Green PC said it's easy for employers to get tripped up thinking they're doing the right thing.
"Not all employers misclassify someone as an independent contractor to avoid paying benefits," Forman said. "Sometimes they do it because that's what the worker requested."
But if companies are deemed employers of the workers who requested 1099s, they'll be subject to all of the obligations required with that status, he said.
