Michael S. Kun, an attorney with Epstein Becker & Green PC who represents employers and listened to the arguments, said he “left with the expectation this would be a 6-3 decision” for the cruise line.
“I didn’t hear anything that suggested there would be an about-face that would carve out an exception for PAGA,” Kun added. …
If the cruise line prevails, Kun said he expects employers will likely draft employee contracts to include similar language to Viking’s.
“There will be a lot of employers in California who decide to implement these programs,” he added.
