The board in this case seemed to suggest it would be justified in refusing to apply the law of any circuit, even if there weren't a single one that supports its position. Judge Brown called this an “exasperatingly expansive” rationale.

“I think that is a leap from where the board has been on this over the years. And it’s a big one,” said Epstein Becker & Green PC’s Steven Swirsky.
