The legislation would amend the Employee Retirement Income Security Act, which sets minimum requirements for pension and other benefits plans. ERISA bars state and local governments from implementing additional restrictions or requirements on employee benefit plans.
Businesses would likely welcome the relief from what's become a patchwork of state and local leave laws, William Milani, who advises employers as an attorney at Epstein Becker & Green, told Bloomberg BNA. But pre-emption can be difficult to pull off, he added.
“There is so much at the state and local level that is either broader than or inconsistent with, in some instances, the federal requirements,” Milani said. “It's not easy to do a piece of legislation like that to preempt the field broadly.”
